Case Status:    DISMISSED
—On or around 01/31/2022 (Notice of voluntarily dismissal)
Current/Last Presiding Judge:
Hon. Charles R. Breyer

Filing Date: November 05, 2021

According to the Complaint, American Century Capital Portfolios, Inc. is a registered open-end management investment company. The American Century Value Fund (the “Fund”) is an open-end mutual fund within the ACCP series of mutual funds that invests primarily in domestic and foreign securities.

The Complaint alleges the Fund’s offering documents and public statements assure investors that the Fund is actively managed. The Complaint further alleges that instead, Defendants engage in closet indexing to mimic the performance of their designated benchmark index, even while charging excessive fees for purportedly active management. In this action, Plaintiff seeks to recover damages arising out of Plaintiff’s and the Class’s purchases of the Fund’s shares pursuant to the Fund’s allegedly untrue and misleading offering documents.

On January 31, 2022, Plaintiff voluntarily dismissed this case.
