According to the Complaint, eHealth, Inc. is a health insurance marketplace with a technology and service platform that provides consumer engagement, education, and health insurance enrollment solutions.

The Complaint alleges that throughout the Class Period, Defendants misrepresented and/or failed to disclose to investors: (1) its highly aggressive accounting and modeling assumptions; (2) its skyrocketing rate of member churn, resulting from eHealth’s pursuit of low quality, loss-making growth; (3) its reliance on direct response television advertising, which attracts an unprofitable, high churn enrollee; and (4) as a result of the foregoing, Defendants’ public statements were materially false and misleading at all relevant times.

On June 24, 2020, the Court issued an Order consolidating cases and appointing Lead Plaintiff and Counsel. Lead Plaintiff filed an amended Complaint on August 25. Defendants filed a Motion to Dismiss the amended Complaint on October 23. On August 12, 2021, the Court issued an Order granting in part and denying in part the Motion to Dismiss.

On November 11, 2021, Lead Counsel notified the Court of the death of the Lead Plaintiff. On November 9, 2022, the Court issued an Order appointing a new Lead Plaintiff and approving Lead Plaintiff's selection of Lead Counsel.

Defendants filed a Motion for Judgment on the Pleadings on December 22, 2022. On September 28, 2023, the Court issued an Order granting Defendants' Motion for Judgment on the Pleadings. Plaintiff was given leave to amend the Complaint.

On October 23, 2023, the parties stipulated to dismiss the case. The Court issued an Order dismissing the case with prejudice on October 25.

On November 29, 2023, the Court entered judgment in favor of the Defendants.
