OPKO Health, Inc. is a medical test and medication company focused on diagnostics and pharmaceuticals.

Plaintiff's law firm issued a press release on September 12, 2018, announcing the filing of the lawsuit. According to the press release, the Complaint alleges that the Defendants made false and/or misleading statements and/or failed to disclose that: (1) OPKO and its Chairman and Chief Executive Officer were engaged in a pump-and-dump scheme with several other individuals and companies in their investments in several penny stocks; (2) this illicit scheme would result in governmental scrutiny including from the SEC; and (3) as a result, Defendants’ statements about OPKO’s business, operations and prospects were materially false and misleading and/or lacked a reasonable basis at all relevant times.

On February 4, 2019, the Court issued an Order appointing Lead Plaintiff and Counsel. On February 5, the Court issued an Order transferring this case to the Southern District of Florida. On May 3, Lead Plaintiff filed a consolidated Complaint. On May 8, the Court issued an Order consolidating cases under Docket 18-CV-23786.

The parties notified the Court that they had reached a Settlement in principle on May 29, 2020. On June 26, the parties entered into a Stipulation and Agreement of Settlement. The Court granted preliminary approval of the Settlement on September 4. On April 29, 2021, the Court granted final approval of the Settlement and entered Final Judgment. On March 23, 2022, the Court issued an Order approving the Settlement's Distribution Plan.
