The Fresh Market, Inc. is an American chain of gourmet supermarkets based in North Carolina.

According to the law firm press release, the Complaint alleges that the Schedule 14D-9 Solicitation/Recommendation Statement filed with the SEC provided materially incomplete and false and misleading information about the Transaction, in violation of the Exchange Act. The Complaint further alleges that, as a result of the false and misleading statements and material omissions, which concealed Defendants’ manipulation of the sales process for the Company, The Fresh Market shareholders received inadequate consideration for their Company shares.

On July 6, 2017, the Court issued an Order appointing Lead Plaintiff and Counsel. This case was voluntarily dismissed on August 15.
