According to the press release, the defendants misrepresented the Company’s true financial and operating condition because it misstated or failed to disclose operating defects and deficiencies concerning the Company’s Lewis leach pad, that rendered defendants’ positive statements about Allied Nevada’s leach pad solutions processing capacity, the Hycroft Mine mill expansion, and the Company’s expected gold and silver production and its expected operating income and cash flows—materially false and misleading. The lawsuit claims that when these truth facts became known, the value of the Company’s stock dropped, damaging investors.

On November 7, 2014, the Court issued an Order appointing lead plaintiff and approving lead counsel. Lead Plaintiff filed an amended and consolidated complaint on May 1, 2015.

On August 8, 2016, the Court issued an Order granting Defendants' Motion to Dismiss. Plaintiffs were given leave to file an amended complaint, which they did on November 3.
