A123 Systems, Inc. ("A123" or the Company) is a developer and manufacturer of lithium iron phosphate batteries and energy storage systems.

The Complaint filed April 2, 2012 alleges that Defendants made false and/or misleading statements, as well as failed to disclose material adverse facts about the Company's business, operations, and prospects. Specifically, Defendants made false and/or misleading statements and/or failed to disclose that: (1) the Company had severe manufacturing deficiencies at its Livonia, Michigan manufacturing facility, which produced defective prismatic cells that resulted in premature failure of battery modules and packs; (2) as a result of the defective prismatic cells, A123 would likely be required to recall and replace the affected modules and packs and incur substantial costs in doing so, threatening the financial viability of the Company; and (3) as a result of the foregoing, the Company’s statements were materially false and misleading at all relevant times.

On June 7, 2012, the Court issued an Order consolidating cases, appointing lead Plaintiff, and approving the selection of lead Counsel.

On August 31, 2012, the Plaintiffs filed a consolidated amended Complaint.

On March 14, 2013, the Court issued an Order granting the Defendants' motion to dismiss the consolidated amended Complaint. Plaintiffs were given leave to replead.

On April 4, 2013, the parties entered a Stipulation of Voluntary Dismissal of this case.
