Emcore Corporation provides fiber optics products for the aerospace, defense and broadband communications markets.

According to a law firm press release, on December 23, 2008, a class action lawsuit was filed against Emcore and several of its officers. The Complaint alleges violations of the federal securities laws, Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 and Rule 10b-5, including allegations that Emcore issued a series of material misrepresentations to the market that artificially inflated its market price.

On September 25, 2009, Memorandum Opinion and Order by Chief Judge Martha Vazquez Granting in Part motions to consolidation and Denying in Part motions as to appointing lead Plaintiff and lead Counsel. The motions to consolidate were granted while the motion to appoint lead Plaintiff and lead Counsel was denied. A renewed motion to appoint lead Counsel and lead Plaintiff was filed. On July 14, 210, the motion was granted in part and denied in part. The court appointed IBEW Local Union No. 58 Annuity Fund as lead Plaintiff, but did not approve their selection of lead Counsel. On September 30, 2011, the judge granted the motion to appoint the lead Counsel.

On November 14, 2011, the lead Plaintiff filed a Consolidated Amended Class Action Complaint. The Complaint was corrected on December 9, 2011. The Defendants responded by filing a motion to dismiss on January 9, 2012.

On September 28, 2012, the Court issued an Order granting the Defendants' motion to dismiss with prejudice.
