The original complaint charges the defendants with violations of the Securities Exchange Act of 1934, alleging that defendants issued false and misleading statements during the Class Period.

According to the latest docket posted, on August 30, 2004, the Court entered the Order signed by U.S. District Judge Harold Baer consolidating the cases and designating the lead case in the consolidated action. On October 15, 2004, the Court entered the Order appointing The Parsow Partnership Group and Central Laborers' Pension Fund as Co-Lead Plaintiffs and appointing Milberg Weiss and Lerach Coughlin as Co-Lead Counsel. On January 7, 2005, the plaintiffs filed a Consolidated Amended Class Action Complaint. The defendant PricewaterhouseCoopers LLP filed a motion to dismiss the Consolidated Amended Class Action Complaint on February 22, 2005. On July 26, 2005, the plaintiffs filed a Corrected Consolidated Amended Complaint. On August 2, 2005, the Court entered the Opinion and Order denying the defendant’s motion to dismiss.

On September 21, 2006, the Court entered the Order preliminarily certifying the class action. On December 27, 2006. The Court approved the Stipulation and Settlement with defendant PricewaterhouseCoopers LLP for $2.8 million. The settlement does not resolve the claims against the Hibernia Foods or the two individual defendants.
