According to the Order, dated January 30, 2003, from the U.S. District Judge John F. Walter of the U.S. District Court for the Central District of California, the action is settled and dismissed without prejudice. The case is closed.

The original complaint was filed on behalf of minority shareholders against Big Fat Fish, Inc., and certain of its directors and officers. The action alleges misrepresentations and omissions to state facts in connection with the sale of securities in violation of Rule 10b-5, 15 USC Section 78j(b); a scheme to defraud in connection with the sale of securities, in violation of Rule 10b-5, 15 U.S.C. Section 78j(b); and unfair business practices, in violation of California Business & Professions Code Section 17200, et seq., and California common law prohibiting unfair competition, in a conspiracy to defraud BFF and embezzle BFF's rights to the Technology and its other assets.
