On September 25, 2003, the Court entered a Judgment in accordance with the Memorandum and Order, dated September 19, 2003, by U.S. District Judge Carol B. Amon, granting the defendants’ motion to dismiss all of the plaintiffs’ claims. The Judgment further directed that the plaintiffs take nothing of the defendants and that leave to amend the complaint was denied. The original complaint alleges that defendants disseminated a materially false and misleading Registration Statement and Prospectus for Optomedic shares and warrants by failing to disclose that sales of the Company's products had virtually stopped by June 19, 1998.
