According to the Final Order and Judgment, dated April 7, 1999, by U.S. District Judge Robert E. Keeton, the settlement was approved. Following the closure of the case on May 11, 1999, a settlement fund was disbursed to the class plaintiffs.

The action charges that Caprius, formerly known as Advanced NMR, made materially false and misleading statements and omitted from disclosure material facts about the Company's publicly reported revenues and sales projections. In particular, the Company materially overstated its revenues and the projected sales of its principal product, the Instascan System, in order to induce the board of directors and shareholders of Medical Diagnostics, Inc. ("MDI") to approve a merger agreement between the Company and MDI which was executed on May 2, 1995 (the "Merger").
