According to the docket dated February 16, 2000, on April 8, 1999, U.S. District Judge William D. Keller dismissed the claims with prejudice. The case was later reopened, due to the erroneous closure of the case by Judge Keller. On February 7, 2000, the Minutes state that the case should have been closed on the entry dated January 31, 2000. The consolidated case was terminated by U.S. District Judge Gary A. Feess.

The original suit contends Keystone issued "false and misleading" statements concerning its operations, earnings and prospects, which led to an artificial inflation of company stock. Seeking to recover an undisclosed amount in damages, the plaintiffs include persons who acquired Keystone common stock within the class period.
