According to the docket, on December 21, 1999 the Court entered the Judgment dismissing the amended complaint. A Notice of Appeal and a Notice of Cross-Appeal was filed by the plaintiffs and the defendants, respectively. On May 10, 2001, the Eleventh Circuit Court of Appeals affirmed the Judgment and Order, remanding to the District Court for purposes of making the Rule 11 findings Opinion attached. On June 13, 2001, the Court issued an Order granting the notice regarding the withdrawal of MMC defendants' request for Rule 11 sanctions.

The original complaint alleges Medical Manager sold thousands of licenses for non-Year 2000 compliant software program to this segment of the health care industry even though the company knew, or should have known, that the software would not be functionally operable after Dec. 31, 1999. The complaint alleges that Medical Manager used false and misleading representations and omissions of material facts regarding the defective nature of prior versions of The Medical Manager software, until as late as November 1997.
