According to the Complaint, Tupperware Brands Corporation operates as a consumer products company worldwide. The Company manufactures, markets, and sells design-centric preparation, storage, and serving solutions for the kitchen and home, as well as a line of cookware, knives, microwave products, microfiber textiles, water-filtration related items, and an array of products for on-the-go consumers under the Tupperware brand name.

The Complaint alleges that, throughout the Class Period, Defendants made materially false and misleading statements regarding the Company’s business, operations, and compliance policies. Specifically, the Complaint alleges Defendants made false and/or misleading statements and/or failed to disclose that: (i) Tupperware was facing significant challenges in maintaining its earnings and sales performance; (ii) accordingly, Tupperware’s full year 2022 guidance was unrealistic and/or unsustainable; (iii) all the foregoing, once revealed, was likely to have a material negative impact on Tupperware’s financial condition; and (iv) as a result, the Company’s public statements were materially false and misleading at all relevant times.

On August 17, 2022, the Court issued an Order granting Defendants' unopposed Motion to Transfer. On August 25, the case transferred in to the Middle District of Florida.

On September 16. 2022, the Court issued an Order appointing Co-Lead Plaintiffs and Counsel. Plaintiffs filed an amended Complaint on November 30.

Defendants filed a Motion to Dismiss the amended Complaint on January 17, 2023. On September 28, the Court issued an Order denying the Motion to dismiss.
