Ousted Chairman Considers Suing Cohen Milstein

EXCERPT: Michael D. Hausfeld, the former chairman of Cohen Milstein Hausfeld & Toll PLLC ousted by the firm last week, has reportedly hired the firm of Venable LLP to explore a possible suit against Cohen Milstein. Hausfeld hired Venable to consider possible legal claims against his former firm related to his firing, the Legal Times reported Thursday. Cohen Milstein has maintained that it did nothing wrong in firing Hausfeld, who had worked there for 40 years, on Nov. 6. Meanwhile, Cohen Milstein has elected a new named partner to replace Hausfeld in the firm, civil rights and employment lawyer Joseph Sellers. The new name of the firm will be Cohen Milstein Sellers & Toll PLLC, according to a statement by the firm. Hausfeld said he was notified through a note left on his chair that his employment at Cohen Milstein was being terminated immediately. It was an “unclassy manner” to handle the separation, Hausfeld said in an interview on Tuesday, not commenting further. The circumstances surrounding Hausfeld's departure from Cohen Milstein, where he had practiced since 1971, initially in the firm's predecessor office, involve “a personnel matter, and it's private,” Sellers said. Hausfeld headed the antitrust and international practice groups at Cohen Milstein. Shortly after he was fired, he opened Hausfeld LLP, a Washington, D.C.-based “global claimants” law firm. Sellers, the new name partner, joined Cohen Milstein in 1997, and has served as the head of its civil rights & employment practice group since that time, according to the firm. He has served as class counsel in more than 30 civil rights and employment class actions involving victims of discrimination and other illegal employment practices.
