EXCERPT: In a motion filed last week with a federal court in Dallas, the Archdiocese of Milwaukee Supporting Fund (AMS) said its relationship with Lerach’s San Diego firm has “deteriorated to the point that substitution of new counsel is required.” The charity proposed placing the litigation under the control of Boies, Schiller & Flexner. Neil Rothstein, an attorney who is advising the AMS Fund, said the fund was concerned that Lerach’s own mounting legal difficulties might pose a conflict with the estimated 800,000 shareholders in the Halliburton suit. Two partners of Lerach’s former firm, Milberg Weiss, have been indicted for paying clients to participate in securities lawsuits, and Lerach himself has been investigated by a grand jury. “My client commends Mr. Lerach on the job he’s done so far, but at this time thinks it’s in the best interest of everyone involved that he step aside,” Rothstein said.
