claims asserted against the Ivy Defendants in Plaintiffs' Second Amended
Complaint for Violations of the Employee Retirement Income Security Act
(ERISA),dated May 21, 2010 (the "SAC"), are hereby dismissed for
reasons set forth in the January 4 Decision, with the exception of
Plaintiffs' First, Second, Third, Fourth, Forth, Sixth, and Eighth Claims for
Relief against Defendants Ivy Asset Management LLC, Lawrence Simon, Howard
Wohl and Adam Geiger (the "Remaining Claims"). The dismissal shall
have the same effect as if it were contained in an order of the Court
granting motions to dismiss filed by these defendants. the Remaining Claims
shall not be dismissed for the reasons set forth in the January 4 Decision.
The parties agree that their consent to the provisions of this paragraph
shall not impede in any way their rights to appeal from, or otherwise seek
reversal of, the January 4 Decision as herein applied to the SAC. All
Defendants shall answer the complaint in this case on or before March 3,
2011. Plaintiffs and Defendants shall endeavor in good faith to serve their initial
disclosures pursuant to Fed. R. Civ. P. 26 and the Pre-Trial Scheduling Order
on or before February 28, 2011; and in any case such initial disclosures
