ORDER:
Motions to dismiss are currently pending before the Court in these related
actions. In the interest of judicial efficiency, the Court intends to rule no
more than once on the sufficiency of Plaintiffs' pleadings. As Plaintiffs
have now read Defendants' briefs and are thoroughly familiar with their
arguments in favor of dismissal, Plaintiffs are specifically advised that to
the extent they believe that amendment would cure any of the asserted
deficiencies, they must seek leave to amend no later than 4/26/2010.
Otherwise, should the Court dismiss any claim for relief in any of the
above-captioned cases, leave to amend will likely be denied. (Signed by Judge
Richard J. Sullivan on 4/15/2010) (tro) Modified on 4/26/2010 (tro).
(Entered: 04/16/2010) |
|
|
04/19/2010 |
ORDER: Accordingly,
if Plaintiffs in any of the above-captioned actions wish to file an amended
complaint in light of the Court's April 15 Order, they shall submit a concise
letter of no more than three pages setting forth the nature of the proposed
amendment by April 26, 2010. By April 30, 2010, Defendants shall submit
letters in opposition. Should the Court grant leave to amend, it will address
the Fe Holdings Plaintiffs' request to seal certain documents at that time.

ORDER:
Accordingly, Plaintiffs shall be granted leave to amend. The parties to the
above captioned actions shall meet and confer, and by May 10, 2010, they
shall submit a joint proposed schedule governing when the amended complaints
shall be filed and when the briefs on the motions to dismiss shall be due.
The Clerk of the Court is respectfully directed to tenninate the motions to
dismiss pending in the above-captioned actions as moot. (Signed by Judge

LETTER addressed to Judge Richard J. Sullivan from Douglas H. Flaum dated
5/7/2010 re: All parties to the above-captioned actions conferred and agreed
to respectfully submit the following joint proposed schedule governing the
timing for filing the amended complaints in the Wachovia Securities
Litigations and for the briefing on the anticipated motions to dismiss those
complaints: Plaintiffs in the Wachovia Securities Litigations shall file
their amended complaints no later than May 28,2010. Defendants shall have
until July 14, 2010 to move to dismiss the amended complaints. Plaintiffs
shall have until August 13, 2010 to serve their responses to the motions to
dismiss. Defendants shall have until September 15, 2010 to serve their
replies in further support of the motions to dismiss. The parties also
respectfully request, so as not to burden the Court with additional
voluminous filings, that they be permitted to refer to the declarations and
exhibits previously filed in connection with the briefing of the original
motions to dismiss the Wachovia Securities Litigations. ENDORSEMENT: SO
ORDERED. The parties shall confer regarding the length of their briefs.
Should any party wish to file a brief in excess of the length stated by my
individual practices, the parties shall submit one joint letter proposing
lengths for all of the briefs. The briefs shall in no event be any longer
than those previously filed, and the parties shall endeavor to agree on a
proposal resulting in fewer overall pages than were produced in connection
with the previous pleadings. (Signed by Judge Richard J. Sullivan on
