ORDER REGARDING NOTICE OF SERVICE OF SETTLEMENT RELATED DISCOVERY by Judge Manuel L. Real. The Court, having considered Defendant Henry T. Nicholas, IIIs Notice of Service of Settlement Related Discovery 491 (the Notice) andPlaintiffs Response to Notice of Service of Settlement Related Discovery:IT IS HEREBY ORDERED This Court affirms its Amended Order Preliminarily Approving Derivative Settlement and Providing for Notice 486 (the Preliminary Approval Order), which temporarily stays discovery, including settlement-related discovery. The Notice and the attached discovery requests were improper and in violation of the Preliminary Approval Order. Defendant Nicholas has not moved the Court to reconsider the Preliminary Approval Order pursuant to the Federal Rules of Civil Procedure and the applicable Local Rules of this Court. For all of these reasons, the Notice and the attached discovery requests require no further response by any served party or non-party. Moreover, Defendant Nicholas has failed to meet his burden to demonstrate that further discovery, settlement-related or otherwise, is necessary to determine the fairness, adequacy and reasonableness to Broadcom of the proposed partial settlement currently before the Court in this action. For this additional and independent reason, the requests for discovery attached to the Notice are improper and require no further response by any served party or non-party.
