| Captec Net Lease Realty Conclusion: According to the docket dated July 07, 2004, the parties entered into an agreement to settle the suit. The Stipulation of Settlement was filed on January 01, 2004. The court on July 07, 2004, issued a Final Judgment and Order approving the Stipulation and dismissing the case with prejudice. The original complaint alleges claims against Captec, Commercial Net Lease Realty, Inc. (NYSE:NNN), and certain of their officers and/or directors for violations of Sections 10 and 20(a) of the Securities and Exchange Act of 1934. The suit alleges that defendants made materially false and misleading statements to the market concerning the value of a note payable to Captec and the value of Captec's interests in a joint venture and certain limited partnerships.
