I, Solomon B. Cera, declare:

1. I am an attorney duly licensed to practice law in the State of California. I am a partner in the law firm of Gold Bennett & Cera LLP, counsel for plaintiffs in this action. I have personal knowledge of the facts set forth below and if called as a witness could and would competently testify thereto.

2. Attached hereto as Exhibit A is a true and correct copy of a letter to Jeffrey W. Lawrence, Esq., one of the counsel to the Ferrari plaintiffs, from Stuart J. Guber, Esq., one of the counsel for the Nevius plaintiffs, dated July 16, 1997.
