Pursuant to the Local Rule 7-3(e), defendants Read-Rite Corporation, Cyril J. Yansouni, Fred Schwettmann, Lori Holland, Peter G. Bischoff, H. Vaughan Blaxter, III, Rex S. Jackson, Michael A. Klyszeiko, and Sherry F. McVicar (collectively "Defendants") submit this statement of recent decision in support of their motion to dismiss the First Amended Complaint with prejudice.
On October 27, 1999, the United States Court of Appeals for the Ninth Circuit denied the petition for rehearing in In re Silicon Graphics, Inc. Securities Litigation. See In re Silicon Graphics Inc. Sec. Litig., No. 97-16204, Order (9th Cir. Oct. 27, 1999). A copy of the Order is attached hereto as Exhibit A. On July 12, 1999, Defendants submitted a copy of the Silicon Graphics opinion to this Court, and as modified, the Ninth Circuit's opinion is reported at 183 F.3d 970. In their July 12 submission, Defendants explained that Silicon Graphics decides many open issues of law under the Private Securities Litigation Reform Act of 1995 and is the law of this Circuit. Defendants respectfully submit the Ninth Circuit's Silicon Graphics decision to this Court for its consideration.
