On March 10, 1998, the motion of defendants TCSI Corporation, Roger A. Strauch, Daniel H. Miller, John C. Bolger, Ram A. Banin, William A. Hasler, David G. Messerschmitt, and Paul A. Farmer to dismiss the Complaint of Albert J. Copperstone and Joseph Siciliano with prejudice, pursuant to Fed. R. Civ. P. 12(b)(6) and the Private Securities Litigation Reform Act of 1995, which added Section 21D to the Securities Exchange Act of 1934, 15 U.S.C. § 78u-4, came on for a hearing before the Court. The Court, having considered the papers in support of and in opposition to the motion, and having heard the arguments of counsel, and good cause appearing therefor, HEREBY ORDERS THAT:
The motion of defendants TCSI Corporation, Roger A. Strauch, Daniel H. Miller, John C. Bolger, Ram A. Banin, William A. Hasler, David G. Messerschmitt, and Paul A. Farmer to dismiss the Complaint with prejudice is GRANTED.
