DEFT'S STATEMENT OF NON-OPP TO PLTF
GEORGE GENNA'S MOT TO BE APPOINTED LEAD
PLTF AND FOR APPROVAL OF LEAD COUNSEL

Defendants hereby state their non-opposition to plaintiff  George Genna's motion to be appointed lead plaintiff and for  approval of lead counsel.  To the best of  defendants' knowledge,  Mr. Genna and his counsel are the only plaintiffs to have expressed  any inclination to pursue this action.  Nonetheless, defendants  specifically reserve their rights to object at an appropriate time  to plaintiff's claims that a) plaintiff can adequately represent  the class of which he claims to be a member and b) the class  plaintiff purports to represent can be certified.  These  objections will be asserted when, if ever, plaintiff moves for  certification of the class.
