The court in Itron recognized that under the Private Securities Litigation Reform Act of 1995, plaintiff's allegations must still be taken as true, and the standards under Rule 12(b)(6) remain unchanged. Ex. A at 1.
Moreover, regarding the standard for pleading scienter, the Itron decision supports plaintiff's position, as in that case the court found that plaintiff's complaint adequately alleged a "strong inference" of defendants' knowing or reckless conduct:
This basis alone -- knowledge of technological incompatibility -- is sufficient to support a strong inference that Defendants knew or recklessly disregarded the false or misleading nature of their statements regarding Itron's Fixed Network AMR.
The Itron court found that this inference was strengthened by
certain statements that such a product would not work in a marketing brochure
dated two years before Itron's efforts to develop the product, and in Itron's
1997 Form 10-K.
